Terms & Conditions
1.General
1.1 These general terms of conditions are applicable to every use of the website www.melkstore.nl & www.melkstore.com and to every offer and quotes from Melkstore and to all agreements between you & Melkstore.
1.2 All photos, graphic designs & styling is made by Melkstore. Melkstore ownes the copyright of these photos and images and therefore it is not allowed to use, post, publish or the like these photos for commercial purposes and benefits. If you wish to use any of these photos please contact info@melkstore.com
2. Realization of the agreement
2.1 The agreement will be realised when Melkstore has received your order and the payment of the order.
2.2 Changing of the agreement is only possible when this is clearly accepted by Melkstore.
3. Shipment of the products
3.1 The prices on the website are inclusive tax and exclusive shipping costs. The shipping costs will depend on the order size and weight. The shipping costs are not refunded by the return of products.
3.2 The products will be shipped by Melkstore within 5 business days, after Melkstore has received the payment.
3.3 Incorrect personal details can lead to a delay in the shipping process, Melkstore is not responsible for any delay in response to these incorrect personal details.
4. Risk during transport
Melkstore is not responsible for any damage, theft or loss of the products during shipping. The risk will be passed to you at the time of sending the products.
5. Right of withdrawal
You have the possibility to return your purchase in consultation with Melkstore and with a valid reason within 14 workdays. This cooling-off period shall begin at the day of receipt of the product. During this cooling-off period you will not use or damage the product. The product will only be refunded if it is returned to Melkstore in the original state, unused and without any damage. If the product is damaged, used or not in the original state returned, Melkstore will not give a refund for this product.
Cost of withdrawal
The shipping costs of the returning products will come for your account.
You will get your refund within 30 days after Melkstore has received the returned product in the original, unused and undamaged state.
Exclusion of withdrawal
1. Returns from the Unique pieces section, named equally on the website, are not accepted by Melkstore. Every Unique Piece is Unique! Please take a good look at the photos in the webshop and the text description before you make a decision to place an order. Because every piece is unique, please note that there can be differences between and within the handmade products. No rights can be derived from the photos on the website.
2. Products with a purchasing price below 15 Euro cannot be returned. (This is the price on the moment you by the product and is not subject to price fluctuations)
6. Assortment
6.1 The selection of products on the site will change continuously. The availability of a product at any one time does not guarantee it´s future availability.
6.2 The Melkstore webshop had a selection of Unique Pieces. These products cannot be returned or refunded. (See article 5)
6.3 Please take a good look at the photographs and the describing text before you buy an item. If you have any questions or concerns about a particular item, feel free to contact Melkstore before you make your purchase.
6.4 No rights can be derived from the star system for the Unique Pieces (explained below). These products cannot be returned or refunded, also not based on a difference in view based on the star system.
- 3 stars: Product is in good condition, but had a little damage.
- 4 stars: product is in good condition, is used and is undamaged
- 5 stars: Product is in excellent condition and looks unused!
6.5 Jewelry maintenance
Some of the jewellery is made of Bras. This jewellery can discolour by different circumstances, like usage of the jewellery and acidity of the skin. For cleaning the jewellery you can best use Brasso&silverpoets. Melkstore is not responsible for discolour of the jewellery and/or any consequences of the use of Brasso&silverpoets
7. Data
7.1 You have to make sure that all your personal details and data, like email address, address details and your account number, are full, right and are still valid. You also declare with accepting the terms conditions that you have the right to make use of the website.
7.2 Melkstore guarantees that all your personal details will be handled with the best care possible. Melkstore ensures that your details will not be traded or sold without your consent.
7.3 Melkstore will process your details and include in the files to fulfil the agreement for your order. Melkstore can also use your email address to keep you updated with news from the Melkstore, unless you don’t give permission for doing so.
8. Retention of title
Melkstore remains the owner of the products send, until Melkstore receives the payment.
9. Payment
9.1 You complete the payment by transfer the money to the account number of Melkstore.
9.2 Melkstore will put the order in process at the moment Melkstore receives the payment.
10. Collection costs
If you are not able to fulfil the payment, Melkstore is able to claim to you all the costs Melkstore have to make because you were not able to meet the payment for your order at Melkstore.
11. Intellectual property rights
11.1 These intellectual property rights relate to the website, the text, the pictures, design, data and other image material, formats, software and brands. This is all property of Melkstore
11.2 You are not allowed to make the website or a part of the website available for third parties or to multiply it.
11.3 You are allowed to place a hyperlink to the website if this will be used for informative ends only. A hyperlink for any other purpose, like an commercial goal is not allowed.
11.4 You are not allowed to make a change in the received product, unless other is arranged.
12. Liability
12.1 Melkstore is not responsible for any damage (indirect/direct) resulting from the impossibility to use the website, or that information on the website is not correct or updated.
12.2 The website can contain references to other websites. Melkstore is not responsible for the content of these websites. Melkstore has no control over these websites.
13. All Other
13.1 Deviations from these terms and conditions can strictly be written agreed. From these deviations can no rights be derived.
13.2 The administration of Melkstore is evidence for your orders or/and requests. U recognizes that electronic communication can serve as evidence as well.
13.3 Melkstore is entitled to present to you these rights and obligations derived from the terms and conditions by a single notification.
13.4 If a provision from the terms and conditions is declared void, the other terms and conditions shall continue in full force.
